The purchaser must acknowledge and sign all terms and conditions, including all clauses, before the sales transaction can be completed. Throughout this agreement, Barefoot Space LLC will be referred to as the company. The FasciAshi Bar - Blueprints are intended to be purchased by massage professionals who have successfully completed the Center for Barefoot Massage FasciAshi educational program and work in compliance with the laws of their state regarding massage. As a Center For Barefoot Massage Instructor, Barefoot Space takes the responsibility of educating others in professional barefoot massage seriously, with the main objective being to ensure that barefoot massage students are properly educated and that the public is safe from harm. Barefoot Space is proud to offer you these blueprints, which are intended to serve as a substitute for the standard overhead bar installation or for events. The frame is designed to surround any massage table, with additional space for walking around, and the blueprints are intended to be made of sturdy steel. Once the blueprints have been released to the Massage Professional, Barefoot Space will not offer refunds. Additionally, the blueprints were created for use in private practice by a licensed professional massage therapist and are not to be reproduced for commercial or private sales. The purchaser is responsible for hiring a professional metal fabricator to produce the product designed and waives all liability and claims for any modifications made to the plans. Barefoot Space LLC is not responsible for any fabrication. Upon receiving the design, it is the purchaser's responsibility to hire a professional to build the FasciAshi Bars. The purchaser agrees to release Barefoot Space from any claims for malfunctions or damages arising from the design and acknowledges the following: 1. Understanding the restrictions and intended use & manufacturing of this design plan. 2. Understanding that this document protects the company from injury or damage to the purchaser, their client, or the bars. 3. Understanding that the intended use of the bar design is for the purchaser to have the unit built by a metal fabricator for their own private practice only. Barefoot Space has priced the blueprints with the understanding that the company will not be responsible or liable for any form of consequential, incidental, statutory, punitive, exemplary, or indirect damages of any kind or type arising from any type of commercial, business, environmental, tort, warranty, contract, strict liability, or other causes arising directly or indirectly from or in connection with any product and/or its use, except consequential damages for any injury to a person in the case of design flaw for consumer use as defined by 15 US C. § 2301. The purchaser agrees not to join in any lawsuit with another person or serve as a class representative of any class action lawsuit arising out of their purchase or use of the ordered design. The purchaser also agrees to defend, indemnify and hold completely harmless Barefoot Space, or any of its affiliates from and against all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to the use or disposition of any items purchased. This agreement shall be governed by the laws of the state of New York and applicable to contracts as if wholly made in any such state. In any dispute arising out of this contract, the purchaser agrees to be subject to personal jurisdiction and venue of the state of New York.
